Legal Question in Civil Litigation in California

Will my vehicles be repossesed

My wife and I purchased a Pickup and 5th wheel Trailer from a private party (Couple A) for $6500. It is transferred completely in our name (we have the pink slip) and everything is completely legal. However, 2 weeks after purchasing the set, My wife met a woman and her husband (Couple B) at the bank. Couple B recognized the truck and approached my wife. They said they sold the Pickup to Couple A approx. 5 months prior to our purchase. Couple A was short on cash so Couple B aggreed to allow payments. After they paid approx. $1000 of the $5000 agreed upon, Couple A vanished. After putting two and two together we realized that is when Couple A sold it to us. Couple B cannot locate them. We know where they are but before we relinquish that info need to know what will happen to us. Will it be repossessd? We took out a high interest personal loan in order to purchase the set. We have everything in writing between us and Couple A. We will give Couple B the info anyways, however as that is a main mode of transportation we need to be prepared.

Thank you.

Re: Will my vehicles be repossesed

If you actually registered the vehicle, have the pink slip, not a forged one, and didn't know of any problem when you bought the vehicle, then you ahould be an innocent holder. But, how did the first couple get the title if they didn't pay for the vehicle?

You need to contact the investigative division of DMV to find out who is the title owner of the vehicle. You can also go to carfax.com to read the title history and see if there are any red flags. Couple B may only repossess the vehicle if they have title. No title, no repo. I would recommend you steer couple B toward couple A and away from you. You could end up a party to a lawsuit which could cost you a lot of money, even if in the end you win.
