Legal Question in Civil Litigation in California

a woman who had an affair with a guy started using the picture of the guy on her profile. The woman took the picture of the guy. The guy did not authorize her to use his picture on her profile. Can he sue her for his unauthorized pic on the web?

Generally not. Unless it is used for commercial purposes, financial gain, to commit civil harassment (not as easy to prove as it sounds), or to place him in a false light in some regard, there is pretty much no legal remedy for it. He may be able to obtain recourse through the hosting service for the profile, however, since there is some authority for the argument that they are gaining financially from it and so many of them in an abundance of caution will remove unauthorized photos.
