Legal Question in Immigration Law in California

change of job after I-485 approved

After my I-485 is approved, how long do I have to stay at my company who sponsored my green card application before I could switch to another company without risking my permanent residence from being revoked? When is my status considered as permanent resident, from the date of I-485 approved or the date the plastic green card issued?

Thank you very much.

Re: change of job after I-485 approved

Hi,

Under the new portability requirements, you could be "safe" 180 days after your i-485 was filed to change jobs. You will need to be careful as to what kind of new position you will be applying and the nature of work. If you fail to meet the requirements your new job might not save the I-485, always consult an immigration lawyer before any job changes.

Upon approval of your I-485 and once you go through the ADIT process (stamp in the passport) you will be considered a permanent resident.

Hope this helps,
