i have a deeport, in absentia...but i have grounds on re-opening case,,,

how long after i re-open my case will i be able to go out with out worrying about warrant?

First, you need to file a motion to reopen. Once your case is reopen, you will go back to immigration court for relief. We suggest you to consult with an immigration attorney.

Dear Inquirer:

Depending on when the order of removal was entered in absentia and whether you received notice of the hearing or some "exceptional circumstances" prevented you from appearing, you may be able to file a Motion to Reopen and Rescind the In Absentia order of removal. In most cases, the filing of the Motion will stay or stop the USICE from executing the removal order, at least until the Immigration Judge makes a decision on the Motion.
