Legal Question in Immigration Law in California

Married to Citizen-Question about Divorce

I am a Canadian Citizen and was going to school on a F-1 Visa. I was Married in July 2003 to a U.S. Citizen. Our I-130, I-765 have all been approved, but the I-485 is still being processed. We are currently having problems in our relationship. If we divorce, will I lose all rights to stay here? Thanks so much for your time.

Re: Married to Citizen-Question about Divorce

If you divorce before the I-485 is approved, you cannot get your permanent residence based on the marriage relationship.
