Legal Question in Immigration Law in California

US wants to marry Canadian without intent to stay

I'm US citizen, she's a canadian

citizen. We'd like to get married in

the US. Can she still come to visit

the US after marriage or will she be

barred? She has no intent on

staying but only visiting until I get

my own paperworks completed to

move to canada.

Re: US wants to marry Canadian without intent to stay

Once you're a resident of Canada, she likely wouldn't have difficult coming as a visitor, though, depending on how often she comes to and is physically present in the U.S., she might be able to qualify as a resident here in the U.S. too, if that was what you wanted.

Re: US wants to marry Canadian without intent to stay

Dear Inquirer:

She could still come to visit, but if questioned at the point of entry she must be entirely truthful as to her short-term intentions. Otherwise, she could seriously complicate her chances of her gaining resident status in the US in the future, should you change your plans.

I recommend that you email me directly or visit www.hanlonlawgroup.com if you would like to schedule an appointment for a confidential consultation to discuss this matter further.
