Legal Question in Immigration Law in California

I want to marry my fiance, who is a mexican citzen, in california while she is visiting on a tourist visa. After the wedding, she will be returning to Mexico to deal with her final affairs. Two months later she plans to return to the United States to begin her life with me. Is this legal?

Before she returns to USA, you have to petition for her immigrant visa, so she can come to USA as an immigrant and obtain her green card/permanent residency.
