Legal Question in Immigration Law in California

Will divorce stop this process?

I have been married for almost 6 months and already know that my husband and I should divorce. We argue and fight constantly and I just cannot trust him anymore. I am very unhappy with him and think we would be better off as friends. He is not a resident and we are in the process of getting his legal residency/citizenship. I do not want to elevate our problems so I want to know if the divorce will stop this process (his legalization) because I don't want him to think that I am doing it as a way to ''get back at him''. Also, how long is the whole divorce process? Thank you so very much!

Re: Will divorce stop this process?

The divorce, if there are no children and assets and liabilities over $25,000.00, then it can be done fairly quickly (approx. 6 months) and inexpensively (approx. $750.00). This however, will stop the immigration process for your spouse since the underlying ground of adjustment of his status will no longer exist. Unless, you are abusing him nd he can claim to be a battered spouse of a US citizen and ask for a special immigrant status.
