Legal Question in Insurance Law in California

Auto Accident Claim

I and my daughter were involved in an auto accident 6 days ago that was clearly other parties fault, we were not hurt but damages was done to my vehicle. Person driving was unauthorized to drive vehicle per insurance carrier, however, vehicle they were driving was insured. How can I file a claim if person at fault was not supposed to be driving. How soon can I start proceedings. I can't drive at night due to headlights busted out and need immediate service. Thanks

Re: Auto Accident Claim

Why don't you simply turn this in to your own insurer which will repair the vehicle, less your deductible, and will probably assist you in obtaining reimbursement from the other insurer.

Whether the person was or wasn't authorized is not so simple a question. And what about that person's own insurance?

If you want to sue now, you can so make sure you name the driver, the owner, and all other potentially responsible parties/businesses.
