Legal Question in Insurance Law in California

uncontrolled intersection other driver speeding but no ticket

I came up to an uncontrolled intersection & was crossing & the car to my right came up to fast she broadsided me & the insurance wants to only 50% of the damages. I had just got my car about a week ago & carelessly didn't pay my payment so it was cancelled only 12 days. The other driver did not get a speeding ticket eventhough she told the officer that she was going about 35 or 40 in a 15 mile speed zone. Would you fight this for them to pay 100%? I am also in the wrong & have to go to court for no insurance.

You may have options depending on the full circumstances. If you feel that you were not at fault, the other driver ought to be liable for it. The issue regarding your insurance is a problem. I would be happy to discuss the issue with you.
