Legal Question in Intellectual Property in California

trademark

I need some help to make an argument for my company name as to why its not descriptive of my goods. I am being required to disclaim the name from my mark so anyone can use it. I.E. Staples is a common term yet it has a trademark.

Sounds like you need a a lawyer to help you figure this out. Probably not a do-it-yourself project.

"staples" is not descriptive of "office supply store", it may be SUGGESTIVE, but by long-term use, it's acquired distinctiveness in the minds of the consuming public.
