Lost Luggage In Lufthansa Airlines

Hy,

I travelled by Luthansa Airlines from L.A. to N. Delhi(India)on 7th jan 2004.Both My baggages were lost,one was recovered in couple of days, other is still missing.The airline people dont want to pay more than $1400.00 in compensation and that too asking for original receipts, which i dont have (all).And the stuff in it was worth more than $3500.00. I went India to attend a wedding there and also to get my album released but due to all this mishap I could not do anything. As it had my Master of Music Videos and i didnt get em on time,coudnt make a deal too.

All my expensive stuff was in it and upon not getting it, I had to face a lot of embarrassment and physical and mental harrassment and stress. Please suggest me if we can sue the airlines,Please help.

Suits for damages for loss of luggages are based on two theories: (1) CONTRACT - Read the back of your ticket and you will note the contractual basis for recovery with the maximum you may get in case of national or international flight (yours is most likely international) and what you have to prove to get some money (receipt, photos and other declarations (of course if you go to trial you can alway testify, other witnesses can, about the existance of the stuff you lost. and (2) NEGLIGENCE - if you are not satisfy with the Airline's response to your loss you can alway bring a law suit for their negligence, if any, in handling your luggages and for all other damages their conduct may have cause you (i.e. distress, aggravation, etc.). Yes you may sue! Check around with specialised attorneys or maybe you can go to small claim court. In any case try to get all the proof you can get about your loss, and good luck!
