3 day notice w/o signed lease

Original tenant (signed lease) moved out of the house and his 2 friends were allowed to move in. They have been paying rent for several months. Lately they are late every month. Can they be served a 3 day notice if they have not signed a rental contract?

Of course. They are sub-tenants, and are required to abide by the terms of the lease. The three day notice to pay or quit is the fastest method of getting them out or to pay.
