evicting a roommate

Hello, I am renting an apartment near Loma Linda CA and I took in a roommate. My landlord knows she is there but she is not on the lease.

It is not working out as she is a lot less responsible than I thought she would be so I am wanting to evict her. She has a child and claims to have no where else to go.

Does she have any legal right to stay there? She threatened to sue if I did this.

Because it is a personal residence, you will need to give her a 60 day notice to vacate (unless she has violated lease terms, such as failure to pay rent, etc.)

Because she lives there and can prove she lives there, you have to treat her as if she were a teant named on the lease.
