Legal Question in Landlord & Tenant Law in California

eviction

Thanks for the previous answer.

I notified the landlord of the fact that I was having trouble collecting monies owed me, which would make me late on my rent,(yearly lease). He told me to keep in touch with him and call him once I had paid. I got a 3 day notice on the 23 or 24, but was out of town. I returned on the 28th, and paid the rent, got my reciept,Left a message on the landlords machine, left town later that week, returning on the feb3 to find that a notice had been served on the door on thurs, the 31st of Jan. I have talked to the landlord, who wants me to deal with his lawyers, and pay all the fees, but his lawyers have not returned my calls. I don't think they know about the payment. Should Ijust file an answer, or should I file a form that says this should be thrown out ? I think they have no grounds to file. What do you think?

Re: eviction

File an answer ASAP. You have 5 days.

If the notice on your door was an unlawful detainer, it is more than a notice.

It doesn't matter what you think, unfortunately. It is what the judge thinks.

Good luck! But, if things start to go bad, retain an attorney.
