Eviction

I received notice from court to respond within 5 calandar days? How do I do this and how much time do I have? Also have prejudgement claim of right to posession. I have no where to go for over a month, what do I do? I only have 5 days to respond from yesterday.

You have five days from the date you were served with the summons and complaint to file an answer. If you are indigent, you can contact Legal Aid. You can find the answer form at http://www.courtinfo.ca.gov/forms/fillable/ud105.pdf. If an adult lives with you who's not on the lease, they would have to fill out the prejudgment claim. You might also fill out an application for fee waiver, http://www.courtinfo.ca.gov/forms/fillable/fw001.pdf and an order http://www.courtinfo.ca.gov/forms/fillable/fw003.pdf if applicable.
