Legal Question in Landlord & Tenant Law in California

eviction rights.

I live with 3 other roommates and we each pay our side of the rent seperately to our landlord. One of our roommates has been late in paying his rent over the past 3 months and we just received an eviction notice because he reportedly did not pay this past month. It says we are all evicted, but is there some legal action that I can take so that those of us that paid our rent on time do not receive any false legal action on ourselves that will reflect in our credit?

Re: eviction rights.

Did you have a written lease? Or was it a verbal month to month arrangement? If a written lease, was that the way it was written? Four separate checks to the landlord?

Re: eviction rights.

You're probably jointly and severally liable for the full rental amount. What that means is that each of you relies upon the other to come up with his/her share of the rent. Accordingly, you're each at risk of any other not being able to pay his/her share.

If the landlord does not receive all the money, you (as a group) have breached the lease.
