Legal Question in Legal Malpractice in California

legal malpractice?or ethical violations?

attorney fails to attend deposition to protect my interests. neglects to inform client of conflict of interest in her firm, dosent tell client of denial on requests for treatment that has 30 day time limit on appealing the decission several of these are received and in file and the repeated calls from not only client but calls from doctor neither of us were told about the denial. told that I wouldnt get to see my treater because my treater refused to say what the insurance co wanted. she has allowed periods of time where I was not treated under the guidelines. My rights violated with refusal of the ins co to approve. necessary treatment. other ins company's would have paid large penalties for their violations. I am still suffering and she takes no action to protect my rights outlined in procedure. I am continuously told she has no answers that she needs to go to a seminar. Im scared and in pain. when asked if she was my attorney she stated, ''She didn't know''. we have a contract how couldn't she know?

Re: legal malpractice?or ethical violations?

Your story could be written more clearly, but it appears you are a workers comp claimant. Unfortunately most applicants' attorneys are the bottom of the barrel among attorneys. If you are in SoCal please feel free to contact me. In the meantime you should try and get another comp attorney (not me).
