Legal Question in Medical Malpractice in California

Failure to treat - I almost died.

MRI revealed epidural abscess on spinal cord as a direct correlation to abscess on two teeth. Broken teeth were a result of 50 mph rear-end collision. About four teeth have been extracted since wreck. DDS denies abscesses are related to car accident even though doctors and internet reports substantiate the cause and effect of the impact and root death of teeth via whiplash.

Dr recommended immediate surgery or likely death due to infection. After 8 day hospitalization, I am administering 20 ML antibiotics via PICC Line directly to my heart for 6 weeks. Two abscesses on teeth continue to threaten my life but I cannot go back the original DDS because he says my abscesses are just from �getting old.�

Is it malpractice that my DDS refused treatment? Got any Ideas? Thank you.

"Ideas?" Yes, if your treating physician is not willing or able to say and testify that the abscesses are a result of the crash and dental problems, then consult with a medical expert in that field to see if you can get such a formal opinion for use in the PI case. That expert medical opinion is necessary to establish that the crash caused the medical problem; neither your opinion, nor mine, matters in court. YOU saying there is "a direct correlation" does not make it true.
