What to do after accident?

I was in an accident 30 days ago, my neck and back hurt now, I am out of a vehicle, how do I go about sueing for pain and suffering?

However, I can't help you without more facts. You leave a number of questions unanswered.

Were you rear ended? Have you talked with the defendant (the one who hit you? Was there a police report? Were you covered by insurance? Was he/she insured? Have you talked to the insurance carrier for the driver who hit you (assuming there is insurance, and that the company attempted to contact you)?
