Legal Question in Personal Injury in California

in accident that was other guys fault. got rental car. filed claim with his insrurance company. they said they will only cover rental car from date they assume responsibilty of accident. is this correct

Clearly not! Their liability starts from the time of the accident. Otherwise theywould never accept responsibility and just settle the case without paying for a rental car. Are you sure they told you that, as there is no way they could believe that. If they kept telling you that, tell them fine, you will sue their insured who will then have a bad failth claim against them.

No if they are responsible for the collision then its from the date of loss. If your vehicle was totaled then his insurance will take the position that they are only responsible for the rental car up to the time they make an offer no matter how inadequate it is.
