Accident Ivestigation going nowhere- next step?

I was in an accident (turning left) and a woman to my left ran a red light and took off the front of my car. The police responded but neglected to write a report or take the name of a witness there supporting my position that she was at fault. Now my insurance company is unsure about fault. I have the police officer's verbal support, but no written report and the process seems to be stalling. Should I get a lawyer involved? What else can I do? I did visit the doctor and miss a day of work because of the accident.

I would strongly suggest that you at least speak to an attorney. Most offer free consultations, and can guide you from here. In most situations, an attorney will make sure a claim is filed, and then send a detailed demand letter -- with a summary of the facts and evidence, witnesses and documents, repair and medical bills, and itemization of pain and suffering and what other juries have awarded cases like this. Coming from an attorney, this gives your best chance for settlement.

As someone else mentioned, you also have the right to go to small claims, or handle the demand portion yourself.

Your statement isn't that clear about how the accident took place. First, talk with the officer or his supervisor since he neglected to do a report and preserve the statement of the witness as evidence. You should always get witness info yourself if you are able.

Did you take pictures of your car before repairs?

Your doctor and wage loss are separate issues. If you can ID the other driver and he has insurance, you go through that company. If not, your uninsured motorist coverage may apply. You should get a free consultation with a PI atty in your area.
