Legal Question in Personal Injury in California

I had accident on my job,I broke my arm and rest ,and now there's is a plat with 11 scroll inside my arm.and the 2 more MRI show that I have problems on my sholder and my scapular and the second MRI SHOWS that I have low disk back problem ( for 4 mm the disk is coming out) and I need sergury.my question is can I sow the company and how long is take? And how much I can take? I worked for company for almost 5 months and my salary is $9 per hour.and until now for almost 5 months the works company they pay me. If is possible helped me?

An employee can not sue his employer for an on the job accident; Workers' Compensation covers you and they pay a set amount for each percent of permanent disability. If a subcontractor was at fault for your being injured, you can sue that subcontractor, but you must show they were negligent.

If someone other than your employer or another employee of the same company is at fault for your injury then you can sue that person and/or company responsible for your injury. Otherwise, you can only obtain compensation from the employer's workers' compensation. insurance carrier as permitted by the Labor Code. You should hire a workers' compensation attorney who can refer you to a personal injury attorney if you can sue someone.
