Legal Question in Personal Injury in California

Auto damaged by garage water leak

One day after the rain, I noticed there were water dripping from the garage ceiling onto my car, and left a couple of big white stains on my front bumper. The following morning, I took my car to the car wash, and they informed me that the stain looked like cement, and they were not able to clean it out.

I have since filed a complaint to the building developer through my condo association. (Since this is a new building) However, it took them several weeks to finally get back to me. They sent one of their contractors, who handles all the building related warranty claims, to assess my vehicle. After he looked at the damage, the contractor told me that the stains on my car was bird droppings. That is just ridiculous. I know they are trying to avoid liability, but at least they can come up with something better than that.

What should my next step be? If I were to sue them, what kind of proof will I need besides pictures?

Re: Auto damaged by garage water leak

Find out the cost to repaint/repair the vehicle and ask the association to either pay for the repair or submit it to the association's general liability insurer. If that doesn't work, submit the claim to your auto insurer if you have comprehensive coverage. Last option, repair and sue the association for the cost of repairs in small claims court.

Small claims, small claims. If you can get someone in the auto body and detailing business to testify as an expert, that would help establish the nature of the problem and the cost to repair.
