Legal Question in Personal Injury in California

My car was hit in a parking lot last month. I exchanged insurance information and reported this to both party's insurances. The person who hit me will not answer the calls from the insurance company, and therefore, the person's insurance company is denying the claim. Would the next step be small claims court? Thank you.
