Legal Question in Personal Injury in California

How can I collect for damages to my car?

2 months ago another driver backed into my car in a parking lot. She has not reported the accident to her insurance company, so they cannot pay for my damages yet, however, they did give me an estimate of the damages. She avoids phone calls and letters. My question is this: Is there any legal action I can take against her personally and not deal with her insurance company anymore? Small Claims Court?

Yes, this is exactly the kind of case of small claims court was designed for. Don't worry about the insurance company. Just take her to small claims court and get the money from her. Let her deal with the insurance company.
