Legal Question in Personal Injury in California

cruise line case

Cruise line is based out of Miami

Florida ( We were on a 7 day cruise

from San Pedro CA and we were

docked in Puerto Vallarta ) We live in

California. Cruise line Contract states

all cases filed in Miami. Would it be

better to get an attorney in Miami

rather than in California?

Where a case is filed can often have immense impact on your rights and the expense of litigation. I would suggest taking the paperwork to a California attorney who does maritime/personal injury law and see if you have a better shot at filing the case in California rather than in Florida. If the injury occurred in Mexico that issue should also be examined, since there may be damage limitations that apply under Mexican law. Make sure he/she doesn't have a conflict of interest with the cruise line before you discuss the case with any attorney.
