Legal Question in Personal Injury in California

Defamation of Character

A former teacher of mine posted defamatory comments about me on a website. She did so under a pseudonym and also gave me (as well as the other students she mentioned) a pseudonym. I was able to recognize myself in the posting and she has admitted that she wrote it (I have proof of her admission in writing). This woman has also made false and libelous statements about me to my school police, her school police, and the local court. She claimed to each of them that I threatened her life and harassed her and was able to obtain a temp. restraining order against me. After hearing evidence from both sides, the order was dismissed. In court she also made libelous statements about me. I have suffered mental anguish, humiliation, and a public ruining of my reputation. All of her allegations and accusations were false and without basis or evidence (which is why it was thrown out). I feel that I should be able to sue her for all that she has put me through without cause. Would this be a viable case of defamation of character?

Re: Defamation of Character

First, you would have to prove that other people knew who she was talking about for the comments on the website. If no one else can figure it out, you have no damages.

Second, her statements in court may be privileged.

You should take all of your evidence to an attorney and let them review it. But, you may have a case.
