Can I file lawsuit?

Hello. My question is if I can file a lawsuit agains nail shop, the person that did my acrylic nails did not glue one of them properly. I asked her to re-glue it, but she said when she put all the powder on top of the nail, it will be as strong as it will possibly get. The next day, I was just scraching my arm and this finger nail broke, but it broke half-way my real nail and I was in such a pain for 3-4 hours I did not know what is going on. I just want to know if I can file a lawsuit, and if I have any chance of winning it.

You should consider how much it will cost you in time to bring a small claims lawsuit, plus the filing fee. By living in a society, it is anticipated that people will have some pain from time to time, through someone else's fault, one's own fault, and no fault. Things happen, unfortunately, that aren't that pleasant. If the pain was enduring and excruciating, it's your decision. If you present your evidence and the court is convinced, you'll win. Just decide how much your 3-4 hours of pain is worth, and ask the court to award you what you believe is a reasonable sum.

You take it to small claims court, it will take a half a day of your time. You will have to decide if the case is worth it. 3-4 hours of pain might be worth only a few hundred dollars.
