Legal Question in Personal Injury in California

Which form

My cousin was served with a civil suit ( auto accident,PI)on a case that has been ongoing for a year now just last week(he wasn't aware of the action/turns out a car he USED to own was still in his name at time of accident. Driver is unknown to him. He is out of state, accident happened in CA. He needs some time to intelligently respond as well as to assess the circumstances that led his name not to be removed from the car's title. Should he file CM-020 ex parte app for extention, or SC-110 request to postpone? Thanks for any help !

First call the plaintiff's lawyer and request an extension of time to answer. Such requests are ruitinely given. Confirm the extension in writing.
