Legal Question in Personal Injury in California

Hi,

My grandmother fell on a large crack 4 years ago at her and my mother's apartment complex in Palm Desert. She broke her hip, never fully recovered, went into a nursing home and die with about a year. This past year that same crack caused a man to fall and now he is dead. The management is vicious and neglectful and is now trying to evict my mother on some technicality of qualification. What is such an injury case called and do we have a case at this point? We have photos of the crack, witnesses, bills, etc.

If they are retaliating then it is called a retaliatory eviction which is not legal and a defense. It sounds like your grandmother's claim is barred by the statute of limitations but there may be an exception. You should talk to an attorney about it asap.
