The code section specified by Mr. Zinder states that parties of an accident have 1 year from the date of the incident to file a civil action for personal injuries, lost wages, medical bills, loss of use of property, future lost wages, ect. You have 3 years from the date of the accident to file a civil action for damage done to your property. After these times limits elapse the parties loose their right to compensation. The statute which covers the one year time limit for pesonal injury claims is Code of Civil Procedure Section 340(3).

There are a few provisions for "tolling" or extending the statute, but these are very rare.
