Legal Question in Personal Injury in California

My son was injured during a summer weight training session at the high school. He was hit in the head with a 35 pound weight. Another kid at an adjacent station was doing squats without using the collars to secure weights. The bar tipped and the weight slipped off and hit him in the head while he was on his hands and knees doing another exercise. He has been diagnosed with a concussion. He has ringing in his ears, alteration in taste on his injured side, etc. After 5 days we had a CT scan, but don't have the results, yet. It is now 7 days and he still has the symptoms. I think the high school contracted with a private firm to run the program. I haven't seen the accident report, but I've heard that they are making misrepresentations to cover their behinds. We have medical expenses and may have more. What can we do?

First, you should get your son to a good neurologist. Chances are the CT and even MRI won't show anything. Most people who suffer from TBI (traumatic brain injury) will not have positive radiographic showing. After he sees a neurologist, you should ask for a referral to a neuro-psychologist for testing. Neuro-psychological evaluation will reveal any possible TBI and resulting cognitive and other issues.

Second, you mentioned he had alteration of taste. This tells me he might have suffered a damage to his 1st cranial nerve. Ask him if his sense of smell is also altered. If so, he might be suffereing from a condition called 'Anosmia' as a result of injury to his 1st cranial nerve. If you get him to a good neurologist without further delay, chances are he will recover from this.

Third, since there a a school involved in this case, make sure to file a governmental tort claim within 6 months from the date of injury, if the school is not private.
