Legal Question in Personal Injury in California

I am being sued for damages, what do I do now?

I recently recieved a summons, that I am being sued for 550k for damages resulting from a mutual combat fight. How do i defend myself, and how do I file a cross suit for my own damages ?

You should tender the defense and indemnity to your homeowner's or renter's insurance carrier. If you have none, for that kind of demand, it would be prudent to retain an attorney.

You would have to file an answer and cross-complaint. You can find forms on the Judicial Council website. But they really are bare-bones, and probably won't be sufficient.

You'd also want to demand in writing medical bills, and propound interrogatories to figure out why the other person is claiming so much money if medical bills are probably nominal.

I'm surprised they're asking for an actual amount, because the amount is not supposed to be contained in the complaint.

Good luck!

Re: I am being sued for damages, what do I do now?

Do all of these:

(1) If you own a home, contact your homeowners insurance (if you rent and you have renters insurance contact them) if you live with someone, contact their homeowners insurance;

(2) If this was an organized event, talk to the promoters and get their insurance information;

(3) Contact a lawyer very quickly. Ask around and get second opinions.

Once you do these, the pros will be able to help you out. Good luck.

You should answer the complaint within 30 days to avoid default. It sounds like you need a competent attorney to file an answer and to file a cross-complaint against the Plaintiff.

Hire a lawyer (ASAP), if you have not already done so!
