uninsured car rear ends my car

uninsured motorist without us driver's license (mexico) hits my rear bumper. it is his brother's car-registered in state of CA. police came & stated could not do police report due to no injuries. driver stated he will pay for damages but is avoiding my calls. i've gotten 2 estimates from shops. should i call my insurance company & have them pay? can I sue the owner of the car in small claims? i do have uninsured motorist protection on my ins policy. thanks

Make a claim with your insurance company immediately. Luckily, since you have uninsured motorist, you will have legal remedies available to you. Instead of chasing after this driver, simply make the claim with your insurance company. You may want to consult an attorney, as I am sure that your carrier will attempt to settle this matter with you quickly, without offering "reasonable" monetary compensation for your accident.
