Legal Question in Real Estate Law in California

Cancellation of contract to purchase

After a week of puting $5K deposit on a new property I decided to cancel due to many items showing up in the prelim title report. In the contract there is a clause to provide clean title report and I was concerned that this builder will be able to do that. How do I get my deposit back?
