Legal Question in Real Estate Law in California

I own a condo and am currently renting out a room. The occupant has been there for the past year and a half. He has never signed a lease or rental agreement, he pays his rent in cash, and has never had any mail delivered to the property address. I want to have him move out asap. What are the necessary steps to take?

You have to give him 60 days notice unless he is failing to pay rent or is otherwise in breach of your oral agreement in such a way as to give you a right to a 3-day notice to perform or leave.
