Legal Question in Real Estate Law in California

Foreclosure - obtaining household items

My husband and I are partners on a property with a relative who lives in the home. Unbeknownst to us, the home went into foreclosure and was sold at auction. The relative is uncooperative and does not speak to anyone. She will be evicted soon. How do we secure our personal property which is in the home?

Re: Foreclosure - obtaining household items

You have a problem. You can seek a court order (called an injunction) to secure and recover the property. Beyond that, once the relative is evicted, any personal property left behind will be place in storage if you don't make arrangements to get it. So you should formally notify the new owners of your claim of ownership and right to possession.

Ask the cops to accompany you there. If not now, you should be able to get your stuff at actual time of the eviction.
