Legal Question in Real Estate Law in California

Neighbor's trees and shrubs...

What are the rights in keeping trees and shrubs from our property.

Can we trim back the trees and send the neighbor the bill?... the neighbor is aware... and is very uncooperative. Thank you

Re: Neighbor's trees and shrubs...

You can trim shoots and roots back to the property line provided you do so in a way that won't endanger their health or create a blow-down hazard.

If damage has been done to your property, you could recover damages in court, but I don't think the court would award you the cost to do the trimming if no harm has been done.

You may trim the trees and shrubs on your side of the property line.
