Legal Question in Real Estate Law in California

The rent for a resident in an independent senior apartment building was being paid through a trust. The resident was taken to the hospital then put into a nursing home. The rent was payed May 1st the resident gave 30 day notice May 8th. May 1st check came back account closed. The deposit on the apartment was only $250 which would barely take care of replacing the carpet. Can we sue the trust?

There are two possible causes of action here, it seems to me. The first would be against the trustee for the amount of the check; the other against whomever signed the lease for breach of lease. Probably small claims actions, probably name both defendants in the same suit.
