do i have rights?

grandfather orally agrees (with handshake) to sell his property to me, 2 days later he passes. do i have any rights to this property?

none what so ever -- as tony the tuna said, "sorry charlie" --- if though within the 2 day period you did something in reliance upon the oral contract to your detriment, mortguaged your house, sold something valueable, really something detrimental relying upon the agreement TO YOU DETRIMENT that may just give you and opening to the door, opening only -- i am in the s.f. bay arear and practing real estate and probate law for over 30 years. if you really have done something call me at 925-945-6000.

No, not really. Real estate contracts must be in writing to be valid. If not real property, you may be OK with witnesses.

mr. koenen is correct. an agreement to purchase and/or sell real estate under all but the most unusual circumstances (which do not appear here) must be in writing.
