Legal Question in Social Security Law in California

mother might not be alive to get rest of her money

my mom recently got approved for social security,after being denied.she hired a lawyer to help get her approved,and was suppose to receive almost 20,000 dollars back pay.after paying her attorney and paying welfare back it left her with almost 10,000.she received a check for 2,500 and was told the new law can only pay 2,500 every 6 months for back pay owed.she has heart failure,liver failure,and copd,and theres a possibility she may not be around for her next check.how can she collect all of her backpay at once before she dies?

Hello:

You can contact the local office where the claim was filed. In the initial interview, you can ask for all of the back monies to be paid due to the present conditions. If your mom cannot go in, she can ask in writing tht you be her representtive and you can do it for her.

There is NO definate way for the "system" to pay her all at once, it is voluntary. NOTE: If you "loaned" , lets say, about $10,000 to your mom and you have proof of doing so such as monthly "notes" that were for the "actual costs" of her living expenses during the appliction through trial phase, then a decision could be made so that you could get "reimbursed" all at once. Talk to your mom's Soc Sec attorney who was paid 25% of the overall alotment.
