Legal Question in Traffic Law in California
daughter's car towed
My daughter's boyfriend, who is on parole and has a suspended license, was driving her car, got upset, started driving eratically, drove the car onto a center divider, blew out the tire and parked at a gas station. They both got out of the car and walked away. A witness called the police and the car was towed away. Now in order to get the car back, my daughter's boyfriend wants her to lie and say she didn't know who was driving it because he's afraid he will go back to jail. How can she get the car back?

Why does she have to lie? She pays the money, she gets her car out of impound. She should say nothing at all to the police, even if they threaten to arrest her or they do arrest her. The only thing she should say if questioned is, "I want a lawyer."

"Why did you leave the car at the gas station?"
"I plead the Fifth, I want a lawyer."
"We know it was your loser boyfriend who was driving."
"I plead the Fifth, I want a lawyer."
"Nice weather we're having, isn't it?"
"I plead the Fifth, I want a lawyer."
