Legal Question in Traffic Law in California

Exhaust / Emission Ticket, 2 of them in 1 week.

Ok, I'm very annoyed by problem I keep having recently for just driving my car 2005 Evolution 8 MR).

I have gotten 2 tickets so far within one week.

One of them I received by CHP officer was on May 10, 2006. For �27151(a)VC - Modified exhaust�. I had plans to go to state referee my self and get the DB tested than get a certification and fight the ticket, so there�s no problem. The exhaust is under 95DB for sure, as the exhaust system is legal in all 50 states to meet the sound specification, and it is a big name brand.

Now yesterday, May 14, 2006, My friend was in town from Connecticut, and we decided to go to Ontario Mills mall area (in S. California) and pick up something for mothers day. I let my friend drive, as I offered him the driver�s seat. We were just driving along, obeying ALL the traffic laws, nothing illegal what so ever. As we passed a street there was a police officer who came right behind us, and pulled us over.

He ended up writing a ticket out to my friend with 2 vehicle code, 27156 and 27150. My friend is from Connecticut, and he is going back today. How are we supposed to take car of this? Will I have to pay the FINE for this ridicules ticket? The car is NOT MODIFIED like the ticket says.

Get the book "How to Fight Your Traffic Ticket" from Nolo Press. This book is well written and should answer your questions. If I were in your position I would immediately take the vehicle to get a smog test and the to have the exhaust system inspected. Assuming that the test and the inspection show that the car is within specifications then take it to the court and the CHP internal affairs and complain. You should also consider contacting civil rights attorney.
