Legal Question in Traffic Law in California

is there a penal code for when evidence is asked for, then not produced?

Is there a penal code regarding a judge or commissioner that will not rule correctly when evidence that he/she has requested is not produced by an officer? A commissioner ruled against me eventhough the evidence (a tape of the traffic stop was ruined while in the custody of the police department that would have proved my innocence), could not be produced?

If there was a court reporter there, file a notice of appeal based on Trombetta v. California, 467 U.S. 479.
