Legal Question in Wills and Trusts in California

assets that did not get moved into a trust

I am a named beneficiary on an insurance policy that did not get moved into a trust either through negligence or deliberately. The trustee has asserted a claim against that policy insisting that it was there intent to move it into the trust. But before they could move it into the trust the owner of the trust passed away.

I believe my children and I have a right to the funds in that policy.

Tell the trustee to go pound sand. Or better yet have your lawyer do this.

And... make sure to file your claim with the insurance company.

If you are the named beneficiary and the trustee has no documents showing intent to move the proceeds to the trust, you will probably prevail. You should consult your own attorney to protect your legal rights.
