Legal Question in Wills and Trusts in California

Conservatorship

Is there any way to get a copy of the confidential supplemental information form filed when petitioning for Conservatorship?

If you are not found to be incompitent by any medical practitioner, will the person petitioning for conservatorship still have a right to get conservatorship?

Is there any way to prove that the person petitioning to be conservator is doing so corruptly?

What can a person do if they do not want a conservator, but a person is trying to force conservatorship on them?

Is there any way to stop a temporary conservatorship?

Re: Conservatorship

The proposed conservatee needs to object to the petition for conservatorship. If the proposed conservatee cannot speak or file the papers, then another person can file objections or a competing petition to nominate themselves as conservatorship.

If there is a hearing on the matter already calendared, you should see the advice of counsel to ensure that the rights of the conservatee are protected.

Re: Conservatorship

The proposed conservatee can object to the conservatorship, and other people can object to the conservatorship as well. The court will also be influenced by the probate investigator's report, so this investigator should hear the objections as well.
