Legal Question in Wills and Trusts in California

fraudulent title transfer

My dad was divorced & his will left his house/everything to me. My mother, claiming to be his widow, transferred title of his house into her name. She refinanced house with my step-father, so now both of their names are on title. They have given me 30 days to get out of house because they are selling it. What can I do? Probate has not been done. Please help!

Re: fraudulent title transfer

As soon as possible, you will need to open a probate adminstration, get yourself appointed as the personal representative and then file an action or petition to return the property to the estate. You may also find yourself defending an eviction proceeding. See an attorney for more details.

Re: fraudulent title transfer

What was the title to the property when your father passed? Were your father and mother divorced? Was there a Probate? Is it completed?

Perhaps it would be best if you contacted me directly and confidentially to discuss this further. I can be reached at the number provided by LawGuru or through our firm's site at No-Probate.com
