inmate inheritors

My husband is currently incarcerated in a CDC prison and his mother is terminally ill. On her death will he be able to inherit life insurance or other cash resources while incarcerated?

Re: inmate inheritors

There is no restriction on inheritance by prisoners, except that those persons found to have caused the death of the decedent cannot inherit the decedent's property.

Your husband may want to sign a power of attorney agreement allowing a trusted person to obtain the inheritance on his behalf and place it into an account in your husband's name.
