in a probate to contest a will when does the lawyer get pay when probate is closed or while it is open?

Whose lawyer? Depends upon what the contract retaining the attorney says. If a contigency fee would be once you actually get somethilng of value, but normally that type of case would be handled on a hourly basis with payment amounts and dates as agreed to wilth the client.
